Hi There!

I wonder if there is someone out there who might know about bailiffs cashing in an order made by the court against a car dealer......I have obtained judgement against a car dealer with showroom, and know that once the deadline for payment is over he wont pay!, terefore I will need to resort to bailiffs at the end, but Im not sure if baillifs call at his show room can take away a car from him to sell since the car dealers dont register their stock into their name and can claim that whats on the premisses belongs to people who have left their cars there for sale.............any ideas! Bailiffs can seize anything on the premises that can be sold to realsie the debt+ costs.

Computers, telephones, photocopiers - it might not bring in the £££s but it will certainly upset their buying and selling.

but there are other ways of trying to enforce the debt

if you know which bank the trader banks with you can get an order forcing the bank to hand over appropriate amount (if you know anyone who has paid the trader viaa cheque for instance you can get their bank to tell you which bank claimed the cheque value)

look at all the options open to force repayment

Bailiffs cannot seize anything on the property, firstly the items must belong to the person (not the household) owing the money, secondly if the said items are required for the persons employment they cannot take those either, i.e. if you're a computer programmer they cannot take you computers, a plumber - your tools etc.

Lastly without a court order to do so (which are very rare) a bailiff cannot enter your home by force, no foot in the door, no pushing the door open, he can enter through a door or window that has been left open. If he says otherwise - he is lying. Once he has entered the properly he can then reenter to seize goods - just don't ever let them in then they are practically powerless. They'll use all sorts of tricks, can I use your phone, loo etc. ignore them, just don't let them in (go outside to speak to them and close the door behind you.)

Finally always make a written offer of payment even if it's only £5 per week and keep a copy, they will almost certainly turn it down, if they do take you to court for an enforcement order, tell the judge your offer of payment was refused and present a copy of your offer. The judge will very likely be peeved at the bailiffs for turning down an offer of payment and will chuck the case out of his court, often quashing the debt as well, as a punishment to the bailiffs for being unreasonable.
