Fixed Penalty Notice For Parking On Double Yellows - cash

Hi guys,

Just want to ask a quick question...

I received a fixed penalty notice today for parking on double yellows but I've noticed that the street name on the notice is incorrect and names the adjacent street.

On these grounds, could I appeal the FPN as I wasn't in the location where it says the offence took place?

Probably. In fact it's likely that you can sue the ticket issueing authorities for mental cruelty & harrasment. I'm sure you can find some com-pen-say-shun chasing lawyer to act for you.

The money for this & the £2,000 per hour for the lawyer will of course have to come from public funds but as long as it gets you off from this disgraceful infingement of your human right to dump your car wherever you want to, it's worth it.

PS if you ever want to park somewhere you can guarantee to have plenty of space around your car so no-one bangs your car door when they open theirs, try the ambulance parking area outside an A & E - for some reason they are always empty!

Thanks for the fast reply, and I do understand that your sarcastic tone would be warranted in most cases. However I only parked there as I had to pick up my girlfriend from work who was being violently ill at the time and it was the closest place I could park. I appreciate that double yellows mean "No waiting" at all, but in the situation where I was no more than 15 minutes...I don't think I quite deserve such a shooting down.

There is alway a reason why someone parks on a yellow line; sometimes with good reason, other times with none.

The tone of my comment was down to the fact that you were looking to get out of the penalty & on a technicality.

Why did you not simply say that you had parked on a double yellow line in what you percieved to be on reasonable grounds (stating what you have just done).

If I had been in your situation, I would have said that I would be prepared to pay the fine but what did people think a defence of collecting my ill girl-friend, would stand up in appeal

It is stated that poster got a FIXED PENALTY ticket for the parking.

This to me means that the local Council have not been granted the authority (decriminalisation) to enforce such matters hence Police involved with a FPN. Had they been so then the ticket would have been a PENALTY CHARGE NOTICE.

Or is the fact that the offence is obstruction which Police can enforce even if Council have been granted power of enforcement?

If it is a FPN then the avenue of appeal is to ask for a hearing at a Magistrates Court under a NG plea. There minor defects if repeated on the summons can be rectified and hearing continue.

If it is a PCN then avenue of appeal to LA in first instance and if they do not accept onwards and upwards to Parking Adjudicator. System is free so nothing ventured nothing gained.

Traffic wardens and the police issue fixed penalty notices. As DVD says you can reject the Fixed Penalty and opt for court. However be aware that in the event of a minor clerical error it can be corrected up to the hearing and the chances are they will do so. Courts don't like people coming to court on what they regard as trivial matters.

You could go for a Special Reasons argument on the illness issue but there is no guarantee of success and if you lose the costs would be substantial.

If it is a Penalty Charge Notice (people often confuse them) then a local government empowered parking attendant has issued it. In that case you can appeal it to the issuing authority which as DVD says is free but if you opt to go to the tribunal then the appeal is not free as you have to pay at the non discount rate.

I would say you have little hope of success with either the court or the adjudicator and could incur substantial additional costs so I would recommend you pay it.

But wht are Blue card holder allowed to park on double yellows

( sigh and I do appreciate that they are legally allowed to do so )

It can make no sense whatsoever iffen the double yellows are there on grounds of Road safety, which apparently they are.

all disabled cars see-through or sommat?. Or how do they differ from non disabled cars?

In respect of blocking visibility?

(i) parked on a double yellow ( which i dont)

(ii) was caught( but see above)

What about the Hackney? anyway some London Council back office staff cancelling tickets issued to friends & relations for parking offences?, & hammering the rest regardless of any "justification"

OP, appeal it on the grounds of loading heavy goods - you did have to carry her, didn't you? Worst that happens is you lose and it costs you £40...
