Car with no horn - significance?

Car with no horn - significance? - Mapmaker
Hired a van just before Christmas which had no working horn.

Following a post-hoc invoice for all sorts of unreasonable non-existent punitive extras just before I go back and negotiate with them, what is the legal significance of this missing piece of equipment?

Failure to maintain an audible warning instrument. Offence to Use (you) Cause or Permit (Them). You're just as liable.

Sorry no - either a Vehicle rectification form (depending on your Police force policy) a summons or a lightweight fixer. No Points. However if there's one defect there's likely to be others, vans are often targeted by Police and VOSA for all kinds of things and all kinds of sins come out of the woodwork then it starts adding up....

Reg 37 Con and use 86 says nowt about maintaining.......

You either have one fitted (working) or not........

Perhaps not. But if a horn is not working the vehicle will fail the MOT.

Well, if you knew that the horn wasn't working at the time of hiring, you should have rejected the van.
Maybe it packed up the first time you used it - maybe not, who knows ?
Hire Co's can't be held responsible for every unpredictable fault that occurs during a hire period, in the same way that you or I can't be accused of poor maintenance if we get a puncture or blow a headlamp bulb during a journey.
