No, the examiner is not deemed to be in charge of a vehicle on test, he is merely an observer and the test candidate has full licence holder status as regards the legality of the drive.
This was established by the court of appeal many years ago when a major driving school tried to sue the Dept of Transport after one of their cars was damaged on a test. The judge ruled that an examiner had no legal obligation to try and prevent the candidate from having an accident.

Seem to remember reading that a qualified driver may not be under the influence while supervising a learner, i.e. no good getting your learner spouse/mate/son/daughter to drive you home from the pub on L plates, it is still you that can get done, whether it is actually drink driving that you would be prosecuted for though I dont know.
