BR people with long memories may recall me seeking your advice on whether to sue a nationally know chain of garages for ruining my gearbox on my now departed Audi.

It came to court today. I won. Yeeeeeeeeeeeeeeeeeeeeesssssssssssssssssss!

Congrats Nsar. Never been involved in a small claims procedure, so I'm curious. What are the chances that the garage will actually pay? What is the sanction if they don't?

The court makes an order against them and if they don't cough up by the deadline set by the Court I sue them again for more.

They're a big National chain so I'd be surprised if they ignored the Court order, but digging my heels in is my strong suit!

In what Court was this handled? Small Claims or something a bit more intimidating? Please tell us a bit more - customer winning v grumpy garage is a story worth hearing!

County court (Small Claims Track) I sued for the cost of repairs + some associated costs of travel - total value c£1500

Just made sure I kept all the correspondence, took a bit of care to present it to the court in an organised, professional looking way that made it easy to understand and crossed my fingers.

Having just refreshed myself on the original thread I must say I would have erred on the side of the doubters as I could not see what could have been done by the garage to trash the auto box. However I did note that the car had been through an MOT and no one had mentioned that it would have been on the rolling road brake tester; perhaps thats where the problems were caused. However I would have thought that those problems would have been mechanical as opposed to electrical.

After having had my Mitsubishi Galant Estate 4WD tested a couple of times normally on rollers, I remember this thread. One thing I think that came out of it was that most brake testers have a 4WD mode. I watched the last time it was tested using this and it was most interesting. Instead of just putting the front wheels on and driving them together and then back wheels the same, it seemed that the rollers were set to operate in reverse directions, so that one wheel went forwards and one backwards so no actual rotation was applied to the drive train. Thus each brake was tested, as the rollers were reversed to make each wheel individually go forward against the brakes. I imagine the performance of a disc brake is slightly different in reverse.
I'm certainly grateful that I didn't have the problems mentioned in the thread, and congratulations to Nsar to have carried it through to a conclusion.
