I agree with the comments of the mother of the vicitim. The punishment was too lenient in my opinion for the loss of a young girl in these circumstances.

For answers to this thread, just read the other 3000 on a similar subject.
For what reason are our courts supposed to hand out sentences? Is it punishment? Rehabilitation? Protection of society? Revenge? Victim satisfaction?
The last two there certainly do not belong, yet in cases like this it is almost impossible not to allow emotion to take control, and then those are what you're asking for.
The man was found innocent of dangerous driving, therefore the court have said that the accident was not his fault, why therefore should he be punished for the loss of a life? And is he not already being punished from the very knowledge?
I would interpret the 'careless driving' charge as something having happened which he could perhaps have avoided, rather than something which he caused.

To add to that I should say: I am playing Devil's Advocate somewhat. I'm not saying that I believe the court to be right, I am saying there's absolutely no way for us to know whether they were or not, and that they have made their judgement on far more information than everyone in this thread is going to.

You discount the role of revenge - OK, revenge is a personal issue and best kept out of the legal system, otherwise you get (for example) feuds that can persist over generations - but there is (and I believe there should be) a role for retribution, which is society's exaction of a price to be paid for breaking its laws.

The sentence should be in proportion to the level of ill intent or the level of recklessness. The problem with driving offences is often the consequences of relatively minor mistakes are occasionally so tragic.
A retributive element in the justice system is not bad thing, it is mark of civilised society: recognition that we are responsible for our actions and this is taken seriously.

Good point - I never thought about that Bazza but the replies so far have been sensible. If it degenerates then I'm sure it'll get locked which is fine by me.
My own personal view is that for the insurance issue alone, the punishment seems far too lenient. The fine is much less than I'm paying now just for TPFT cover. Hardly seems fair. Especially coupled with a careless driving charge.
As for the case of the poor girl dying, well as you say BB - we don't know all the facts but I'd be upset if I were the parents.
Oh well - I'm not a judge and thankfully, never will be so I won't have to deal with these type of things.
