Good day all, hopefully one of the backroomers can give me some info ...
A young man from the colonies works in Britain.
Last year, the day police stopped him, and he had provided a roadside breath test which had a reading of more than twice the legal limit. But, the bench heard, he would not give a second specimen later at the police station.
He has now been caught driving while disqualified, and obviously no insurance.
What sort of punishment could he expect? best and worst case scenarios, please.

A blast from the past or what, where have you been ?
Prison is the worse case scenario. More likely if he's working is a hefty fine on a the basis of pay now before you run off to SA. oh and more points. Has he had bail ? that is usually a good indicator ?

Arrested and locked up Friday morning, granted bail Friday afternnon - no doubt after his employer's intervention. Appears before magistrates Wednesday.
Oh, as far as my absence goes, I've been busy on a lot of things, and also the IT Monkeys here saw a fair few references to 'honestjohn' on the 'sites accessed' report, and had a gentle word in my ear about proper use of internet facilities...
Other people received a less-than-gentle word (and a close examination of the pavement outside!) , after it seemed the bandwiudth had been clogged up with constant visits to some real X-rated stuff...

Good to hear your alive Ian and hopefully well....?
Not good news and PU mentions possibly the best. The worse (max)if they go whole hog (rarely they do);
Fail to supply specimen for analysis
6 mths imp, fine £5000, Obligatory Disqualification 3 - 11 points
Drive whilst disqualified
Summarily 6 months impr £5000 fine, discretionary further disq, 6 points
No Insurance
£5000 fine, discretionary disqualification, 6 - 8 points.
Any previous cons will not help matters.

No previous convictions that I know of.
The chap involved plays pro sport, so "doing a runner" from the UK is not likely.
I know he copped a 3K fine for the original offence in December, and apologised for the lack of sample, blaming 'language problems' for his lack of understanding.
I shall keep you posted, as and when we hear more.

Alas, it will probably be just a slap on the wrist. My choice would be to remove a finger, as a warning.

"My choice would be to remove a finger, as a warning."
Turbo 11, have you spent time over in the sun ? That used to be the punishment administered to thieves by the tribal Headman. It was done by use of a special ceremonial axe with a very narrow blade.

Probably not imprisonment for a first offence and a fine is a possibility if he's lucky with an extended disqualification.
Instead he's likely to be looking at a Community Order with Supervision Requirement or a Community Order with a requirement to perform unpaid work. Basically both of these come under the auspices of the Probation Service - in short either probation or community service.
A second or third DWD and he'd be looking down the sharp end of Custody. Bail is a virtual certainty unless he's of no fixed abode or already on bail for a similar offence. (I can't see how DWD could be prosecuted by way of Summons - more likely back to the police station then charge if agreed by the CPS then bailed to appear at Court).
