I drive down this road every morning on my way to work. Is this sign legal? Its at the entrance to an industrial estate with a VERY rough road. There are more pot holes than in a pot hole factory!

I can't see why it wouldn't be legal - but there's nothing to enforce here. It's a 10 MPH sign in an triangle - ie it's not a prohibition, not a speed limit. It's just a warning to keep your speed low. The actual speed limit will be whatever defined for the road leading into this.

DVD's your man for this but I would expect the fact it's the wrong shape, has "MPH" on, and other clutter would suggest it's not legal at all.

Has the road been adopted by the local authority? IMHO if not adopted then it is a private sign on a private road warning users about its poor condition. If you then decide to exceed 10mph and damage is caused to your car by a pot hole, then they will deny probably liability to any damage caused.

This sign is like the 20mph signs put up by roadworkers after they have put down that god-awful chipping stuff over wet tar. It is not legally enforcable, but advisory only.Its a cop out incase of claim so they can say 'we told you so'. If its not a legally defined 'road' the land owner can put whatever sign up they want, if it is a road, check with the local highways authority if it's sancioned buy them which it must be.

The sign does not conform to anything under TSGD 2002 but nevertheless could be an authorised advisory sign if special permission given by Sec of State.

Would need a Traffic Regulation Order for a 10 mph and very doubtful under circumstances and not generally given unless convoy system in place at road works.

The 'rough 'road whilst being open to the public at large may well be classed as a road under Road Traffic Act but still be private. The sign may well be an attempt by the owners of the road to negate any claims for damages resulting from negotiating the potholes as speed.
