Sometimes on my travels I pass a car that has been abandoned. If I remove the car (using a trailor) am I breaking the law, even though it's obviously dumped and the owner clearly doesn't want it?

Yep. DWD has stated repeatedly that you can't do this as is effectively theft. You must report to Police and local authority and it may be offered to you if no-one claims it within a few months - but in practice they are scrapped.

Several years ago my partner saw an abandoned Citroen CX behind Halfords. He asked the staff whose it was and they did not know, so he asked if he could take some parts off it and they said go ahead - so he did, and nothing ever happened to him.

There was an article in MCN a couple of weeks ago reporting on a loophole in the law regarding the registration of vehicles.
What it was saying was that theives can steal a bike and then register it in there own name in 14 days and there is nothing the police can do about it.
I can't find the article to get the full details at the moment.

I think they way it worked was that they apply for a new registration document in their own name saying they bought it. The DVLA writes to the existing recorded keeper and if no reply within 14 days they issue a new V5 to the thieves. I couldn't believe it when I read it, but yes, plod said they couldn't do a thing!

I'd be interested to hear DVD's take or that of a lawyer. May well be that DVLA have followed their procedures and no issues arise under registration regs. But V5 is not proof of ownership and fact of removal with intent to permanently deprive remains.

Back on the subject of helping yourself to bits from dumped cars, ISTR a thread a while ago, where a legal expert BR member mentioned that a client had been charged with theft for taking something from a skip.

It seems that the police don't necessarily need charges to be pressed by an aggrieved party to charge the person responsible.

Personally I would like to see a system that lets people who spot an abandoned car remove it themselves after the statutory time period has passed. Obviously there would have to be caviats present, like maybe a time frame in which to move it, and the council would need to know who's taking responsibiliy for it, so it doesn't end up dumped again with all the useful bits removed.

Maybe an undertaking that it will be disposed of in a proper manner, rather than simply draining the oil down a storm drain would be necessary.

In my area there is a scrap yard that will accept most cars at no cost and has been known to give money for them more recently with the higher steel prices. This yard is now set up as a proper ELV facility.

The only problem is that you have to get the car there.
