my mate is an artic lorry driver who has reciently been spotted by trading standards driving along a 7.5 tonne weight ristricted road, he has now been summonsed to appear in court and is wondering what would be the likly penelty.

Sign that has been contravened is No 622.1A Traffic Signs and General Directions 2002. Whilst a Regulatory Sign (red circle) i.e. must be obeyed it is not a sign as listed that Section 36 Road Traffic Act 88 applies - fail to conform to Traffic Sign offence with fine, discretionary disqualification and points as penalty.
The sign will have been erected to indicate a Traffic Regulation Order made by Local Authority under Road Traffic Regulation Act 1984, Section 5 of which states that it is an offence to contravene the Order. Punishment is outlined at Road Traffic Offenders Act 1988 with Maximum fine of 1,000 pounds. No disqualification, endorsement or points. Doubtful max will be applied. Will be up to the Magistrates and based on the seriousness of the offence and what financial enquiry of defendant reveals.
Depending on the status of the Court there could be power to disqualify under another Act.

Hi Plumber,
I too am a artic driver and have had my collar felt for this very offence, i couldn't deny the offence due to photographic evidence, i was lucky and got away with a £75 fine. Your friend could expect around £75 to £150. Good luck to him.

Sorry, have I lost the plot, I know we seem to have yet another form of pseudo police officer every week but can a Trading Standards officer really enforce Traffic laws?

TS have now quite an involvement in Traffic law i.e.Stopping vehicles, Weighing, test certificates, garages to name few.
Even you cockle can report, I you have the details popalong to Mags Clerks and take out your summons......
In above case may well be they provided Plod with a witness statement and he followed it through.
