Also from this weeks Spectator, a fine magazine that will be made all the better by Mr. Johnsons departure (you heard it here first).
Apparently it is ILLEGAL to have a For Sale sign in the window of your car, unless the car is NOT on the public highway (such as when it is on your dricve).
To sell goods on the public highway you have to have a street traders licence. So they did this guy for having a For Sale sign in the window of his car and impounded it for the year it took the case to get to the magistrates court.
The guy got a small fine but the local authority said he couldn't have the car back until he paid the storage fees which came to several times what the car was worth so the car will likely end up crushed.
Meanwhile the local drug gangs are fighting a turf war outside your window. The lunatics have taken over the asylum and the Council chamber near you.

yes absolutely
what about number plates, after all the ho ha about "you must have a national marking on the side of your number plate" nonsense lots of main dealers have gone back to plain old plates with no flag or nationality on them, does this mean the state troopers are going to come round and crush all these cars one night?

And does this stop at signwritten vans?

Road side sales, banned under Highways Act 1980 S 147A only mentions using a vehicle on verge of a Trunk Road or Layby of such a road or unenclosed land within 15 metres of such a road, amongst other things, for purpose of selling anything, which I take not to include that vehicle itself. Possibility of danger has to be proved.
But under S 7 Local Government (Miscellaneous Provisions)Act 1976, then if the Council, if they think such action is necessary to avoid danger and facilitate the passage of traffic, may make a Control Order prohibiting a person selling ANYTHING on the Highway.
Does the Spectator make this clear?

The hoo hah about the number plates was that the option of a "dual plate" originally could only show the EEC Blue and stars with the nationality characters (GB). As a result of protest, regs amended to allow flag of the country, but not that of the local footie club.

Regarding point no.1, I hope the practice of offering cars for sale on the public highway, grass verges etc is stamped out completely. Apart from any other aspect, it just makes the place look untidy. Some people may be happy to live in an untidy neighbourhood, but I for one am not.
Regarding point no.2, if this occurs in your area then indeed it needs to be dealt with ~ but not at the expense of allowing other misdemeanors.

Everything is illegal now, unless you have a countersigned licence and have been on an approved training course.
|
The problem as I see it is as follows
1. Car traders park their cars in high visibility street locations and then leave the car there for days at a time until they are sold and then another car re-appears.
2. Residents complain that there streets are being used as a free car showroom. (and I believe that some of the traders dont have adequate insurance, tax on cars nor pay tax on the sales)
3. Council then look through their bylaws to stop the practice and find something they can prosecute this with.
4. Over zealous offical decides that ALL cars being sold on the highway are in fact illegal and then wages a war against anyone and everyone.
5. National or Local Newspaper picks up the above and only reports on point 4.

More right wing scare-mongering. Puntoo's right. Blimey, it's tedious... Yes, I agree that the impromptu used car lots are scruffy and cause problems. Legislation exists to combat this. No, we do not live in a police state. Next question...

Or compulsory.

yea but some dealers round here have gone back to plain yellow plates at the back and plain white ones at the front, with neither EEC blue or flag of England etc
so I guess this particular regulation must have been relaxed?
|
This guy was NOT repeat NOT a trader doing this multiple times. He was just a guy with a sign For Sale in the window of his car.
You may dismiss it as right wing propaganda if you wish but it happened and the person relating the tale is the magistrate who sentenced the guy so this is not a third person report.
The point is that government have given up on serious crime and now focus on easy targets and there are none easier than the law abiding registered traceable asset owning motorist.
|
I would take that on - breaching people's human rights - How else does one sell one's car ?
|
I'm glad this topic has cropped up, as I'm planning on selling my car and was going to put a sign in the window. If you don't actually write "For sale" would that get around it? All I was planning on doing was sticking the price, a couple of details and a phone number on it. It should be rather obvious from that it is for sale!
|
Putting up a For Sale sign is not selling the car. That is merely an "invitation to treat". Selling is when having agreed terms, you conclude the contract and exchange money and documents. That might take place in your house, in a bank, or in a pub.
|
Think about it. As Pugugly and others say, there's nothing ipso facto illegal in putting a for sale sign in your car window. So, thought about rationally rather than hysterically, there must have been SOME reason why this guy got done. We're not being told the whole story!
No more Spectator articles, please. It's the Daily Mail with a higher reading age. This is a motoring forum, not one for political polemics...

A man in Derby was recently prosecuted and fined by the local authority for displaying a protest banner in his garden, against the plans for the new inner ring road in Derby. I think some business or other was listed on the banner and the case was based on the accusation that it was an illegal advertisement.

Since this is not staying motoring oriented, I've locked it.
Everything that needed saying has been said, anyway.
