Well, it had to happen. One of our household has had our first ever speeding offence. A notice arrived this morning asking for details who was driving the car etc. It also said it was a notice of "intention to prosecute" and gives no mention of any fixed penalty.
So it is a first offence but the speed was 43mph in a 30mph area. Does the lack of "fixed penalty" imply a court appearance.
Any info or ideas on what might happen next would be greatly appreciated.

1) confirm who was driving & return letter
2a) receive a letter asking for your driving licence & the money
or
2b) receive notification of court data, send form off pleading guilty, enclosing licence, and completed means test for.
3a) get licence back with points
or
3b) get letter with notification of punishment
43 in a 30 is quite a lot, but you wouldn't have got a notice of the penalty at this stage whatever.
Send it off and hope.

If you know you or one of your family did it you are probably best to take the punishment. However, are all the details on the NIP correctly stated? Date/time/place/name of road etc. If it is a major error of fact (not very likely) you might have an out.

Did your son/daughter/granny have their bum out the window when the flash went off...nooo??Well then I think it unlikely that your son (I presume) will be up before the beak unless you are living in an area which is particularly rich and puritanical. If it is bothering you...phone them up and ask them what the score is.

Mark succinctly outlines procedure.
On return of the first papers (NOIP) to Reg Keeper naming the Driver then ACPO Guidelines on Prosevcution should kick in.
i.e. for a 30mph limit then FP is offered for the range 35 to 49mph. 50 and above goes to a Mags Court.
So a Conditional offer will be made for you to trot along to the Mags Clerks Office within 28 days with the DL, pay 60 pounds, collect 3 points. The DL will be taken off you for DVLA to record the points and returned.
Note if a Phot Licence you will need the counterpart as well.
Note this only applies if you produce a DL with less than 9 points otherwise MC will decline and book you a Court apperance for possible disqualification.
