Ford Focus - Used car fault 2 days into ownership. What do? - sparerib

Hope I may get some help here, bit of a catch 22 situation. I purchased a Ford Focus 04 plate on Satruday from a dealership. Had test driven it, checked history, mots, even had the dealer do the cambelt prior to picking up. No problems so far. Car comes with 6 month warranty. All was well on the 3 mile drive home and initial run about. Having driven it 20 miles the next day, a knocking was sounding from the wheel. Only on slight turns and more noticeable when drving the car from the initial start up rather than once driven for some time, however it has since been sounding intermittantly at higher speeds. Best way to describe it is the wheel seems to meet some resistance when turned to 11 o'clock / 1 o'clock and takes extra effort to turn, especially when steering left. It also sounds when turned full lock to the left.

Today I have taken back to the dealer who put it down to lack of fluid in the power steering pump which he said he'd refilled (I wasn't convincd this was the issue). They wouldn't put it up on the ramps to have a closer look or inspection, even though we did ask. I took the car round the block with a mechanic driving and to be fair, no more sounds at that point. Mechanic advised to give the car a good run over the next few days to see if the problem returned. I agreed to continue using it and said I'll be back if the problem retruned. 2 miles up the road, same knocking, just as bad if not worse than before! I then took it to two independant garages locally who have both confirmed that there is a fault based on the knocking sound, but neither can tell with certainty what it is without taking the car in properly which I'm reluctant to do. The first garage said probable failure of the steering rack, second said unsure but possibly the UJ or related to the rack. Mechanic at the second garage said the fault will almost certainly get worse over time, but the amount of time is unknown.

Having only a 6 month warranty on the car, what do I do? Take it back and ask for repair (hoping they solve it) or reject the car and get a refund as I cannot afford the car to pack up after the 6 months if it's related to the current fault. I'm reluctant in letting the dealer touch under warranty tbh, purely because of his lack of care/bother in inspecting the car when we took it back today as requested and the cba attitude in helping.

Anyone have any experience in this sort of thing? All help appreciated!

You are in luck.

The law changed on 1st October this year.

www.honestjohn.co.uk/news/miscellaneous/2015-10/bu.../

As of that date (so as long as you bought the car after 1st October, which is the case for you), you are entitled IN LAW to a full refund for a faulty car within 30 days of purchase.

As such, I'd suggest you get in touch with the garage, inform them of your new rights, and tell them to refund you in full. You've already proved to yourself that they can't be trusted or bothered with aftersales and customer care.

If they ask to be allowed to try to fix it, it is your choice. Personally I'd be telling them to get stuffed, and hand the money back.

Thanks for the reply. If they had been a bit more helpful inititially, I might have considered letting them do the work under warranty.

As I understand the new act, any return after 30 days gives the seller a little more room for manouvre i.e can deduct fair usage from refund amount. It might also allow the dealer to say a repair has been made (in good faith or otherwise) only for it to possibly return later on wihtout me having any recourse to a proper refund. Shall contact the seller and cut my losses!

Cheers.

I think you are going to be hard pressed to argue that a knock on lock on an 11 year old Focus makes it either not fit for purpose or unsatisfactory.

It is one of those things with older cars - I suspect the warranty will just argue fair wear and tear and something has just worn out.

If they'll agree to fix it then just let them and consider you've done OK. Maybe it will come back, maybe it won't - it is an 11 year old car - something else will wear out and/or break and/or kill it eventually.

There is clearly a fault that hasnt just occurred overnight or in the 40 odd miles I've done in it. Imo the seller at the very least should have looked at it properly when I took it back ti the garage.. The new law will hopefully be enough to sort it out.

You've still got to have proper grounds for rejection - a bit of a noise on an old car really aren't good grounds. If the headgasket had gone, or maybe if it was brand new, fair enough, but it hasn't.

Tbf it's a little more than just a knock. Hard to describe but turning the wheel when moving jolts the whole car, even at low speed. Doesn't feel safe.

A number of things it could be. If it is that clear, at least you'll know if they have fixed it.

Look at it this way: if they agree to fix it then I'd just let them. If you return it you'll only go and buy something else which in 04-Focus range will probably have something else wrong with it and maybe the seller next time will refuse to fix anything.

At least you've had the car long enough to know all that is wrong is some iffysteering/suspension and if that can be resolved you've got a working car.
