I will be transferring ownership of my daughters car to myself in a couple of months when she emigrates. If its done on the last day of the month, she gets refunded the remaining months but do I pay an extra month because its still the last day? Alternatively if its done on the 1st of the month does she lose a months refund?

Your daughter will get a refund based on the date the she informs the DVLA of transfer of ownership i.e. the day she sends off the V5C with your name on it. The refund has nothing to do with when the new owner re-taxes it because that is up to you, but if you use it on the road before re-taxing it you will potentially face a fine.

But since you can tax on-line or over the phone before you take to the road that would never happen, would it.

I don't think there's any way round it. You end up paying twice for one month's tax, whatever way you do it.

Yes but what about the few hours or even minutes in between, could I be fined even though the car is parked on my drive? i.e. computer says no?

Lets presume this is not a wind up.

I cannot see how you would since cars are not taxed by the hour. It would be taxed until the end of the month your daughter transferred it to you. You are then taxing it the very next day. It would not be untaxed for more than a few hours.

As an example, what if my tax had expired at midnight yesterday and then I retaxed it before I set off to work this morning. In theory it would have been untaxed for possibly 7 hours but I cannot see how they would pick that up and set off on a prosecution, think they have bigger fish to fry. In truth the moment I taxed it I paid the back tax anyway.

But as you appear worried do as you suggested before, simply SORN it the moment you aquire it and then tax it when you get up the next day.

No its not a wind up, but I'm concerned this scenario is deliberately avoided in the faq on the dvla website.

Declaring Sorn seems to be the way, however, only the registered owner can declare sorn, so imo my daughter should declare sorn on the last day of the month online, then we send the v5c bit off dated the same or next day, and I retax the next day.

I think the deliberate policy of the dvla not to offer advice shows they want their extra months tax. Apparently they have issued soaring numbers of fines (£80), I not sure if they can fine you just using the computer record of a break in tax, or whether you have to be caught on the public highway.

In the grand scheme of things how much will this cost you? One month tax.

Simple facts:

The car will be taxed on the last day of the month.

It will be retaxed on the first day of the following month.

Will the DVLA system be clever enough to spot the gap.

If you think it will you have 2 options, tax it and loose and months tax, or SORN it and spend nothing.

The decision is yours from a choice of 3, bit like daytime television but with no really obvious correct answer. But I know which I would do.

My understanding is that the system is not triggered until the tax is a month overdue.

Therefore you could tax the vehicle on, say, the 15th without alerting the DVLA to the gap, but of course you would need to pay from the beginning of the month.

Technically you are correct, but today I spoke to the DVLA and, on selling, if the vehicle is not used on the road on the last day of the month ( or transported by low loader) it is OK to apply for VED on the first day of the following month.

As the OP is selling " in house" he could keep the vehicle off the road on the last day of the month and tax on the 1st.
