Mitsubishi Outlander - Dealer increasing price - MRMONOCHROME

I've been looking for a Mitsubishi Outlander for a while now and spotted one advertised on ebay, autotrader and a couple of other sites which fitted in with my budget at a Mitsubishi dealership last week.

Chatted through the details and price with one of their salesmen and he suggested paying a refundable deposit to secure the car until I could get over to see it and take it for a test drive. Having missed out on one prior to this I agreed and paid £500 which was described by him as 'an amount which makes sure both sides of the deal are serious'.

Next day I received a call from the garage saying that the car had been advertised incorrectly and should have been an extra £2500 and they wanted to know if I was still interested.

What I'm essentially wanting advice on is whether I have any recourse to get the car at the original price. Does my payjng a deposit constitute a contract of sale being formed and if so can they then back out of it so easily? Any advice or help would be very mucb appreciated.

in short, no. An advertised price is an invitation to treat not a contract and the deposit was merely to stop them selling the car to anyone else, not to buy the car.

Probably just a sleazy trick to coax you in to paying more.

Get your deposit back and give them the bird. They'll probably capitulate.

Then again, this trick would put me off dealing with them; how are they going to handle after-sales issues..?

Pay the price or walk. They know the value of the product and like any bussiness they wont walk into a loss. They wont loose any sleep about you backing out either, they could sell it next week at the higher price, or tomorrow, or in 30 mins time! Mitsubishis are popular and good sellers but numbers are always limited so sizeable discounts are rare.

If you are still keen I would try to cut a sensible deal and as a starting point I would suggest splitting the difference to them.....or if its not a factory order say to them give me a call if in a month if it hasnt gone and you want to renegotiate.

Thank you all for ypur replies. I think I already suspected there was nothing to stop them changing the price but it's good to have the confirmation.

The search for an Outlander will continue.
