was just wondering if anyone knew if you could get a custodial sentence imposed for a speeding offence??

My other half had a 6 month ban which was only lifted 10 months ago for totting up. The other day he was caught doing 117mph!!! We know he will most certainly get banned again, but is it possible he could go to prison????

Any help would be greatfully appreciated!

The help you need is a specialist motoring solicitor to represent your OH in court.

Nothing else is going to help him.

As he has had a previous ban and the speed is high, he needs proper representation.

For a pure speeding offence I am not aware that prison is applicable, but if the prosecution tries to hang dangerous driving onto it as a consequence of the speed, prison is an option-that's why he needs a specialist solicitor.

Road Traffic Offenders Act 1988 only prescribes that the offence of speeding can be dealt with summarily (Mags Court) and does not allow imprisonment in the sentence.

Whereas Dangerous driving on indictment carries imprisonment in the punishment.

The the OP's other half needs to have a long and serious think about their driving habits prior to getting their licence back, they will 100% loose it for 117mph regardless of the limit on the road at the time.

If they have such a need to drive at high speed perhaps they should consider track days to get their kicks, driving at 117mph on public roads is simply not acceptable.

In fairness to Cris, he was perhaps thinking that 117 in a 50 limit would look a hell of a lot worse than 117 in a 70/nsl.
