When I bought the Evoque the salesman made much of a failsafe device in the fuel filler neck which would prevent misfuelling. Filled diesel car with petrol and drove about a mile. Dealer denies any liability for the failsafe device not operating correctly. They say that if the petrol nozzle isn't pushed all the way into the filler neck then the device won't operate. The device has operated however but still allowed fuelling at normal speed. They now say well perhaps you only pushed it in at the end of fuelling. The upshot is that they want around £6000 to put it right claiming it needs a new tank pump, new injector pump, new injectors, fuel lines, etc. OK we made a mistake but if something doesn't work properly and results in other damage surely there is the basis for a warranty claim. I have asked them to approach Land Rover for a contribution but no response.

I have never ever heard of a misfuel prevention device not working. They are now fitted to all Fords, many BMWs, many Citroens and many Hondas as well as to Evoques. If it went to court it would set a precedent and I don't know which way the case would go. Yes, the device should have prevented the misfuelling. But you should still have taken some care over what fuel you were trying to put in.
