Peugeot 3008 Hybrid4 problems - can I get a refund?

My Peugeot Hybrid4 has failed for the third time in less than a year with the latest being that the prop shaft has snapped and knackered the gearbox (happened at 10mph). I am told that it will be a month at least to fix. I have had the car for over the sixth month grace period and was assured that the new charger would fix the problems I had experienced before (they had the car for three months). The car is 2020 registered and has covered just 18,000 miles.

Quite frankly I want my money back now as I believe that the car was faulty at the time of purchase in December 2020, given all its issues especially such a huge failure of the prop shaft. What can I do?

The dealer is entitled to be given the opportunity to fix the fault. If they are unable to repair the car then you are entitled to a refund or replacement vehicle of similar age and spec.

You may have grounds to argue the car is not of satisfactory quality, but it would be better to work with the dealer. I would start by making a formal complaint to the service manager. Explain the problems you have experienced and put forward a proposed solution that would be acceptable.

Take note, in the event of a refund, you would not get all of your money back. The dealer is entitled to make a fair deduction for the usage you have already had from the vehicle.

Legal action should be your last resort. Due to the high value of the car, this would not be a Small Claims Court matter (which is limited to £10,000). This means you would face lengthy and expensive court action if the dealer refuses to accept your rejection.
