Very doubtful....

There is an offence under Reg 100(1) M.V.(Con and Use) Regs 1986
of carrying a passenger in a manner as likely to cause danger to any person on a road.

Depends on how far they stick out and what they are likely to hit.

Don't know, but I was following an artic on the M3 in the middle of the recent heatwave when it suddenly swerved onto the hard shoulder and back onto the carriageway. As I passed it I noted the driver's right foot was out of the window. I didn't believe it, so I let him pass me, then overtook him again to check. Definitely his right foot, bare, resting on his wing mirror bracket.

I toyed with calling the Police, and settled with calling his company and giving the ID number on the back. I'm all for relaxed driving but he was an accident waiting to happen.

Ah Vin..... a very different kettle of fish a driver doing this.

Fixed Penalty book out and ticket issued for driving a motor vehicle on a road in such a position that he cannot have proper control of the vehicle.

If the passenger's foot is only out as far as an elbow I cant see what danger that could represent.
Many drivers/passengers hang most of their arm down the outside of car door on a hot day. Not saying its right or safe, just common.

I know hanging body parts out of windows is illegal here, except when doing hand-signals.
However, it is one of those 'on the books' laws which is seldom enforced.
AND there is an advert for a motor-financial institution featuring a bloke driving along with his whole arm out the window, waving in the breeze ...

And today, by coincidence, further down the M3, I was passed by three bikes, all with lookalike Jam Sandwich paint jobs but with yellow rotating flashers where the blue one on a Police bike would be. No organisation name on the sides. All were doing 80-85mph.

The front rider of the three was standing on his pegs (as high as he could still reaching the bars) and the other two were riding with both legs stretched out almost brushing against the floor. The front one was about ten feet from the back of the car in front, and the others were spaced about ten feet apart.

Now, I used to be a courier (long distance stuff 50% of the time) and I know you get a bit stiff and need a stretch, but doing your stretching while 10ft from the vehicle in front is a bit naughty.

Wonder what stunt I'll see on the M3 next week? Someone jumping from an artic onto the bonnet of a car while riding a motorbike?

The bikes sound like military fleet, for escorting tank transporters & the like. Did they have conventional registrations? Surprising antics, for our Forces, to ride in this manner!
Could be less experienced riders, moving the bikes for 'FOLLOW ME' duties, on temporary road closures, somewhere.
No excuse for this style of road behavior & I wouldn't even get on a bike, parked up!!

As an aside, the Germans crash tested a car with the passenger dummy slouched back with its feet on the dashboard (very common laid back posture in Germany, I've observed). Results showed the deployment of the passenger airbag would have killed a real passenger...
