How can I appeal an unfair parking fine?

In December, I booked and paid for a long-stay parking spot at Liverpool Airport. When we arrived in the pitch dark at 5.45 in the morning there was a driver standing at the entry barrier saying he had driven around for 20 minutes and was unable to find a space.

I drove around for 15 minutes and like many other drivers I couldn't find a space and, because of the time, parked behind another vehicle on yellow hatched lines. We were not causing any obstruction and I explained this problem at the information desk inside the airport.

A month later I received a £100 fixed penalty notice from Vehicle Control Services for parking outside designated boxes on private land. I appealed explaining there were no spaces available and have just had that rejected but, as a "goodwill gesture" it has been reduces to £60.

I'm assuming I entered into a contract with the car park firm to provide a parking space. None was available. I believe the parking firm was in breach of its obligations and failed to provide a space that was identifiable. Am I right and do you reckon I have any chance of success?

Circumvent this by getting in touch with the management of the airport. You pre-booked a space in an airport carpark. When you arrived, no spaces were available and you had a plane to catch. That is a completely unreasonable breach of contract by the carpark.

Make it very plain that if the action against you is not dropped immediately you will sue the airport itself for the penalty imposed by its appointed enforcers and for your time that this has wasted.
