Noisy first gear on a 350Z

I bought a 58 plate Nissan 350Z from a used car dealer, and I noticed it had a bit of a whine in first gear. I google'd it and saw that it could be a characteristic of that gearbox but took it to Nissan dealer anyway just to look over it 13 days after purchasing the car.

Nissan reckoned there was a fault with the gearbox to do with a splinter in first gear. However there is only 2 days left on the warranty and they couldn't fit me in within the warranty period and told me it would be down to a goodwill gesture from Nissan to cover some of the costs.

Nissan refuses to agree to covering all the costs costs and I am liable for the stripping charges and repairs if they claim wear and tear, which could lead me liable for hundreds.

I spoke to the person who test drove it on the last service (done by the used car dealer) and they said they didn't remember there being an issue, even though it has been present since I bought the car.

Where do I go from here? is the used car dealer responsible for the problem for not providing a car in a satisfactory condition, or is Nissan for not honouring their warranty, or even myself for not being more thorough when first buying it.

You needed to make your complaint a lot earlier because the problem is something you could have induced. If you had notified the Nissan dealer that sold you the car well within warranty you might have got some goodwill even though the problem might have been due to a clumsy gearshift. As it is, your treatment still seems a little unfair, so I'd push the dealer and Nissan a bit harder.
