Winter driving in Germany

I want to hire a car in German this Christmas. The hire firm is telling me winter tyres are extra. Hasn't the law changed in German making winter tyres compulsory? So if the hire firm gives me a car without winter tyres is it not effectively unroadworthy as soon as I get on a public road? Should the tyres not be standard fit?

They are only compulsory in snow. You get a fine if you are caught driving on summer tyres on snow.
