I was hit by a van who was half on my side of the road as we approached each other. The driver admitted to me that it was his fault as the sun was in his eyes (although the sun was behind him at the time) and he was apologetic and provided me with all his details.

Unfortunately my insurance provider say that it is not progressing as his insurer or he is not admitting liability.

I have a witness who overheard him admit to me that it was his fault, but he had a passenger who could assist him in avoiding blame although this is not the case at present. Will my witness statement be enough to convince his insurers of his guilt?
