Faulty Toyota Yaris gearbox - what are my options?

My daughter bought a new Toyota Yaris auto hybrid in September 2021. Last week she had a warning that the brakes were faulty and a loss of power. The dealer says the car needs a new gearbox and is dangerous to drive because the electric handbrake could apply at speed. What are her options with a car that has such a severe manufacturing fault?

Your daughter is entitled to a repair, replacement or refund, in accordance to the 2015 Consumer Rights Act.

Unless the dealer can prove otherwise, it would be accepted in law that the fault was present at the time of purchase. However, if your daughter pushes for a refund, the dealer will be entitled to make a fair deduction for the usage she has already had from the car.
