Hi All

I desperately need someones help. I recently bought a car and as soon as I bought it I got fully comprehensive insurance on it. It has a current MOT but doesn't have tax. It was today towed away and impounded for the no tax. However, the DVLA still don't have it in my name as they say it can take 4-6 weeks to process and that's if the guy I bought the car from sent it off straight away. My insurance documents haven't arrived yet and the post office I went to to get my tax told me I had to bring in original insurance documents to prove my insurance. So I cannot get my tax at the post office and cannot order it online as it still isn't in my name. I live in a terraced house and so don't have a driveway and therefore cannot take it off the road. I just think this is SO unfair. I could buy the tax today its not like I'm trying to avoid it. The impound are going to want hundreds of pounds from me to get my car back and I cannot do it yet as they will want to see the tax first. Plus they conveniently close at 16:30 just before I was able to call them so I will have to wait until the morning.

Anyone at all have any advice?

Go to a police station and, politely but firmly, ask them what they advise you to do in your situation where through no fault of your own you can't tax the car. Do you have any friends who will let you park it off-road until the tax disc comes through?

Do you have the New Owner section of the V5C. The dealer should have given you this and a trip to the post office with this, a valid insurance cert and MOT would have resolved this. You knew you were not taxed. Regards Peter

With all due respect, the OP does state in his original post that the insurance documents haven't arrived yet so he couldn't take a document that he does not have to the post office.

If you had completed the sale and left the vehicle untaxed on the road then it is game set and match to the DVLA clampers. How long had it been there?

PO will not issue Excise until proof of Insurance produced a well known fact.
Car Poiunbd will want to see Insurance before release and a current Tax.

Car now in pound where it will accrue stortage fees daily in addition to removal cost.

Plus DVLA will be wanting their pound of flesh for use without Excise.

In this day and age one has to be super careful in relation to vehicle documentation .... a salutory lesson to others.

The only mitigation to DVLAs pound of flesh is the tax owing by the OP is small. A tax disc bought now or in a day or two will cover the untaxed period it was in the OPs ownership.

In this case, although the OP will have to pay the storage and release fees - DVLA will get poke all more back from him since the tax liability will be covered the moment he taxes the car and the amount of a fine for a few days untaxed won't begin to cover their expenses. Indeed, they'll try to get back tax for when the OP was not liable - so watch it.

Obviously shooting at the former keeper and caught someone who although guilty, is very small beer.

Keep ALL paperwork, and copy anything you send off. I hope you have a receipt.

I feel very sorry for OP. MOT and insurance details are stored on a central database so couldn't the OP have bought a tax disc online? It is perfectly legal to drive a taxed vehicle whilst the tax disc is in the post. I've done this and simply put my printed DVLA receipt on the dashboard.

Another reason to scrap VED.

Only online if you have the reminder with the 16 digit Reference Number. I'm afraid the OP drove a vehicle on the public road and parked on the public road with no tax. What part of not being taxed did you not understand. Regards Peter

For how long was the car untaxed? Strikes me he would be quite unlucky to be towed "instantly", judging by the number of apparently untaxed vehicles seen lounging about. So, how about a timeline for this?

I meant to ask that question as well. Suspect the previous owner may have kept it untaxed (or even driven SORN'd) for some time. Surely tickets and admin penalties would have been tried first.

The OP needs to have an open conversation with whichever authority, presumably either Police or DVLA, lifted his car.

A person is not guilty of an offence by using or keeping a vehicle on a public road during any of the 5 working days following the time when

a licence or nil licence for the vehicle, or

a relevant declaration applying to the vehicle, ceases to be in force,

if an application for a licence or nil licence for or in respect of the vehicle to run from that time has been received before that time.'

To me, that sounds like you may have 5 days to tax it. after all, If your the new owner common sense should surely prevail ;-)

You could have had a V10 completed upon pick up to prove the point if your stopped.

Section 147 (above) has to be read along with Section 33, VERA 1994 and inserts new sub section into Vera.

Section 33 Vera deals with DISPLAY of an Excise Licence and allows non display providing there is a continuation of duty through application for a new Licence and gives a 5 day grace for non display. Someone said now 10 days but I cannot find the extra days at law.

It does not alter the need for an Excise Licence i.e. duty whilst the vehicle is on a road..

You have 5 days in which you can continue to display the old licence while you wait for the new one to arrive, the 5 days only applies to disks bought on-line before the expiry date and is there to allow for postage delays.

If you do not buy a new disk before the old one expires and you continue to use it on the public highway yoau are guilty. If you buy a car that is not taxed and use it on a public higway before taxing it you are guilty.

In 38 years of driving I have never failed to tax my car thus I have never been fined or towed. Why should the law breaking scum get away with it. I say tow and crush their cars.

Since the OP's not been back I'd guess the situation is resolved.

In 30 odd years of driving I've forgotten the tax, or filed it under do later/when paid a few times. In reality I think you'd be extremely unlucky to be reported for prosecution until a month overdue. I also suspect crushing would be regarded as disproportionate for those other than proven serial evaders.
