3.5t and 7.5t box vehicles - motorway third lane - wozh

Hi. What is the law on 3.5t and 7.5t gross box vehicles,in relation to motorway third lane use.
, for example :

The right-hand lane of a motorway with three or more lanes MUST NOT be used (except in prescribed circumstances) if you are driving

* a goods vehicle with a maximum laden weight exceeding 3.5 tonnes but not exceeding 7.5 tonnes, which is required to be fitted with a speed limiter
* a goods vehicle with a maximum laden weight exceeding 7.5 tonnes

Does this mean that a fully laden 3.5t box vehicle,weighing exactly 3.5t or under ,can use the third lane.
And that a fully laden 7.5t box vehicle weighing exactly 7.5t or under can use the third lane,if they are not speed limted.

A Goods vehicle has a plate on which is stated the maximum laden weight, which has not to be exceeded (overloading). It is this weight that is used under the Motorway regs irrespective of what is under carried....it is still 7.5 mlw.

So above:

If it is plated at exceeding 3.5 tonnes and not exceeding 7.5 tonnes AND not required under Con and Use to be fitted with a limiter then it can use lane 3 or 4 as the case may be. If it has a limiter then it cannot use..

The idea being the higher the mlw the bigger and slower it is going to be.

Hi, Thanks for your reply . I still don`t understand. What is con. also plates view in order the maximum carriage weight,the gross weight,weight on the first axle, weight on the second axle and the third if the vehicle has one.

Sorry for not being to the point, Can you tell me if I can use the third/fourth lane if i am driving 3.5t gross box van with no fitted speed limiter.

Can I use the third lane/fourth,driving a 7.5t gross box wagon with no fitted speed limiter.

I need to know for monday 9th. phoned the highways agency(no joy), then the department of transport(no joy),then dvla who told me to ask the police.

If your box van is plated up to 3500 (max gross weight) you can use the offside lane.

If it is plated between 3500 and 7500 and IS NOT REQUIRED to be fitted with a Limiter under Reg 36B Motor Vehicles (Construction and Use)Regs 1986 then you can use the outside lane. If Limiter - No.

If it is plated in excess of 7500 you cannot use the outside lane.

(Motorways Traffic (England and Wales) Regs 1982 Reg 12)

If you are in confusion then treat your box van as being in excess of 7500 and keep out of the outside lane. You will get to your destination just the same without incurring the wrath of the BMW's etc up your rear or the unmarked Plodmobile after a quick easy speeder..
