Hi,

This weekend we're picking up a used car and trading in our Ford Ka.

We've agreed a total price for the deal but that doesn't include any RFL or fuel, the guy even told me 'we're not a petrol station' :)

On that basis I'm inclined to say that I'm not a post office and that I'll cash in the tax on our car before he gets it.

Seem reasonable?

Totally reasonable - especially given the apparent attitude of the other party. Leaving RFL on a car you're p/ex'ing (if not specifically agreed in the overall deal) is like leaving fivers in the glovebox- make sure you're on reserve fuel as you enter the dealer as well!

That's the question, does the price that I'm getting for my car have some kind of loading for the fact that there is tax remaining that they will be cashing in?

There's nothing written down so I think it's fair game.

Did the dealer mention RFL in the value of your car specifically? - most never mention signifigant equity still left on RFL in the hope you'll just leave it - and sweeten their deal.

Certainly, when you buy 2nd hand, RFL is always 'on top' of the negotiated price IME.

He asked if it had tax, but nothing specific went into the 'sums' that made up the deal so I'll be cashing it in and using it to pay for the tank of fuel I'm not getting :)

whenever I've traded in the garage has never expected the RFL to stay with the car. I recall one time I received a call from the guy that had bought my trade-in asking if I still had the RFL, not having been to the Post Office yet I did, so said yes. Couple of hours later he was at my door asking to buy it so I sold it to him at the pro-rata rate. Later I was told that this was the wrong thing to do as he could then drive it around 'looking legal' but without insurance.

He asked whether it had tax, therefore, he's included that in his valuations. Remove it if you feel confident enough, but have it ready to hand back over should they ask for it.

One of my customers sat there and point blank refused one day which made things very awkward and sort of ruined what had been a very friendly exchange up until that point (they had even handed in a letter to my DP telling him how wonderful I was!), I could tell that his wife was squirming. Not worth the embarassment for £40 if you ask me but it takes all sorts I suppose.

The RFL is a licence for you to use the car in accordance with the terms and conditions, and is not strictly a physical part of the car.

If it's how you feel about it, tell the dealer you'll be taking the tax disc off the car before you hand it over. Incidentally, you can't apply for a (partial) refund until after you've stopped using the car.

He'll no doubt moan that you've taken it off saying he'd taken it's value into account in the p/x price but if it wasn't mentioned during negotiations then take it off. The time before last, the salesman reminded me to remove the RFL during handover!

I took the disc out of the EOS on Saturday, told the dealer, SWMBO was embarassed.

The disc that was in it when they valued it had expired and we had re-taxed it so they had no claim on this one! Worth about £70 to us.

Now if the original disc had still been valid and he had included it in the allowance I would have left it in the car.

I assumed it was part of the deal I agreed but when I traded my Civic in I was actually told by the salesman to take the RFL ( about £50 worth ) off it .

Don't know if modern rules prevent this now but when I was at university in the seventies one of my friends had family who owned a Datsun dealership, his transport used to be anything they had as a trade in that still had valid tax & MOT on it to use until the tax ran out.
I guess maybe then a few months tax wasn't worth an awful lot.

This weekend ? So December 1st (or 2nd) then. You'll be needing some VED - road tax - for the month of december then. Remove the disc before you get to the dealer and either:
1) hand it back over if the deal goes sour (unlikely)
2) post it off to swansea on your way home, claiming for a rebate from Jan08.

It is a bit late to be claiming a rebate from Dec07 anyway.

I was a bit hasty on the send button :)

I won't be removing any of the car's parts, that would be dishonest.

The fact that the seller is doing strictly the minimum (no fuel, no tax) makes me want to do the same.

If he was going to put on an equivalent amount of VED to that on the car I was giving to him, no problem, but he's not. Also I was totally honest in my description of our car but it wasn't until we'd exchanged cash that I found out that the car only comes with 1 key and remote fob, instead of the pair it should have - that's going to cost me at least £50 to get a key and fob, so I feel justified in getting back a few quid for the tax.

I wouldn't ring your hands too much over the RFL Lou_o - it certainly doesn't sound like the dealer is pushing the boat out here in winning the deal. In fact, I'd be rather tempted to tell him I'd found something better (any contract and/or deposit permitting) - he sounds a mean old skinflint to me - a couple of gallons of fuel surely wouldn't hurt on a trade-up deal?

yep, take it off, most main agents cash in any tax remaining on part ex's anyway, only to sell them on without tax to other traders. It's another form of income.

I have for my sins sat through far too many management/accounts reviews at franchised dealerships and I can assure you that income from surrendering RFL's is surprisingly high.

Check the small print of your agreement, it will probably say something along the lines of "value of vehicle as inspected on such and such a day" which will include the RFL.
