Dear all,
After some shenanigans & seeking, the GF has found & put a deposit on an MX5. It's a black UK 1.8iS, 1997P, excellent nick by the look of it. One owner, history, good price at £2995. All looks straight, panel gaps good, engine pulls cleanly in all gears. Rear nearside brake makes a sort of wooshing noise, but pads look fine & MOT is just a week or so old. It's from a sort of 'dealer', basically selling from his driveway, so no warranty. I'm going to HPI check, and 'dealer' is going to have the electric window switch replaced (intermittent on passenger, non-operative on driver's), and have the brakes checked again. Looks great. GF is worried- would like to have checked either by a knowledgeable friend of RAC. Is this necessary from a dealer? Even though he's not offering warranty, there is comeback id there's a serious problem? He says he got the car from a garage. I'm suspecting trade-in offloaded.
Is this price suspiciously low? Prices for mx5s seem to be all over the shop. We looked at a very tatty 1992 eunos that was up for £3500, with MOT about to run out, faded paint & requiring new front discs!

Presumably he admits to being a dealer? But dealing from home? Is that his house or a mates? If that's all kosher then he has by law to give you a 3 or 6 (I can't remember which) month warranty anyway, whether he likes it or not; its implicit in the deal.

Cheers EIII. He's on his own drive (nice big pad out in Kent, several cars in the drive), and advertises in the autotrader as a 'trade' seller. Sounds like there is an implied warranty, even if he doesn't know about it!
Any legal eagles know which statute/ section (I'm thinking SGSA maybe)?

Sale of goods act - product needs to be free of defects for 6 months from point of purchase. Wear and tear is not included in this.

I assume this means there is no such thing as a free lunch? I do tend to be very suspicious of such things, but the car does seem incredibly straight. And the price is about right for a good private sale (and quick, which I think is the motivation).
Well, I think with my shield of the SGA, we will purchase the little devil.

Hmm...make sure you keep a copy of the ad so he can't pretend later it was just a private sale. Get a receipt as well. If in doubt get it checked out at a garage of your choice - maybe just get it MOTed again?

pesonally, i steer clear of anyone who says things like "nice to drive", or "first to see will buy". or "excellent condition" when there are faults to be fixed.
also, when i buy, i do not do so thinking i have the soga to back it up. soga has to be a last resort hassle for me.
if your car is one like that, you decide whether you want to be that first to buy.
car purchases can be an emotional thing. if someone likes the look of a car, they will often elect to ignore very obvious problems staring them in the face.

I know what you mean, Dalglish. I am also naturally suspicious of those phrases (and he did use 'first to see will buy' on his ad)!
I've probably painted this worse than it is! The car seems extremely honest, and is a little below what I'd have expected it to be up for. He's agreed to rectify the e/w switches, and have the brakes checked. I think it's just paranoia feeding off itself, really.
The knowledge that we have soga is a safety net- if he was offering a warranty, I wouldn't be thinking twice!
