On Sunday 12/05 I bought the car above. Drove home 250 miles away. On Monday found a knocking/rumbling noise from the front (at low speed) asked by the dealer to take it to garage couldn't find the fault. On Thursday there's all oil over my drive way. Dealer says take it to a garage and let them know.

Inspected Monday gearbox seal gone, gearbox under tray missing. Dealer asked for it to be returned by recovery which I went with him and returned with courtesy car. Now I've lost confidence in the car. they are repairing replacing with recon gearbox, but I don't want it back.

So Ive had the car less then two weeks - Do I have the right to ask for a refund? I purchased using part/x on mine, cash and credit card payment.

Assuming the repair is successful, I highly doubt it. If there is a clearly defined fault and the dealer identifies and rectifies this problem then they have fulfilled their contractual obligations.

Many thanks for the reply. However the fault with the oil leak was there before we left the dealers. So I have to accept that he has repaired the car to a satisfactory standard in the hope that it will not develop any more faults?, under his 3 month warranty?

Then the question is what is the point of the SoGA if it has been sold with a fault? Which is where I am getting confused.

The point is that the dealer is obliged to rectify the fault at his expense. You can only reject a car if it is is 'unfit for purpose'. A fault (even a serious one) doesn't in itself make a car unfit for purpos because if the fault is rectified, then the vehicle is functions as it was advertised.

I don't understand why you would 'lose confidence' in the car if it has a reconditioned gearbox fitted. The recon box will be guaranteed.

Yes the dealer can fix the repair should he choose too, however i am under the impression that i dont have to accept a repaired car back when the car was sold with faults

Its a bit nerving knowing you have drve 250 miles home, with a gear box oil leak and you have got some wierd noise coming from the front of the car.

Never mind that he put new brakes on it before we bought it, but forgot the shims. The fact that the gear box undertray is missing too is a worry.

Besides that the dealer is also AA inspection centre, makes you wonder what they actually inspected.

Loose confidence - I think that is an understatement.

You travelled 250 miles to buy a car and never inspected it ,what shims were missing,and you drove 250 miles with the car making noises why did you not take it back when you first heard the noise,You will find if you study the soga regulations and look at tribunal outcomes you do not have much chance of rejecting the car but there is always a chance.

Contrary we did inspect the car. I've had various cars over the 29 years I have been driving and always bought from dealers.

The noise what undechtable, and you only noticed the noise when the car is in neutral when moving slowly, not something you would do on a test drive. The brake shims - would you have noticed these? Never mind asking a customer to look under a car to find oil leaks - I doubt any person buying a car would look for these/or do this - beside the garage we took it too after the request of the dealer found these missing not us.

Trading Standards and the c/c company both advise we can reject the car and get our money back.

You did not expect the car very well or take any notice when you test drove it you can hardly hide an oil leal or noises or did these not occur until later in which case how would the dealer know .You still have not explained the missing shims if these are the anti squeal shims then with certain pads these are not required. and what has 29years got to do with it my wife has had cars for 33years but still has problems remembering where to put the fuel

.I hope you have a succesful outcome to your problem the dealer seems to be doing his utmost I would wait and see how the car turns out after the work has been done.
