My Citroen C4 Picasso has previously been repaired - can I reject the car because the dealer didn't tell me?

I took delivery of a Citroen C4 Picasso about six weeks ago from a recognised Citroen dealer. After having cleaned it several times I've become aware of extensive damage repair. I was made aware that it was an ex-hire car through my enquiries, but at no time was I informed of the accident repair. I had to wait more than six weeks for this particular car and the dealers excuse was new ECU and, later, fitment of a new door seal. This should have alerted me, but I didn't ask the obvious question. Where do I stand with regards to compensation or rejecting the car?

If the dealer knew it was damaged and repaired he was legally obliged to tell you. The Consumer Protection from Unfair Trading Regulations May 2008 (CPRs) contains a general prohibition against unfair commercial practices and, in particular prohibitions against misleading actions, misleading omissions and aggressive commercial practices. The Regulations are enforceable through the civil and criminal courts. This creates an offence of misleading omissions which would not previously have been an offence if the consumer had not asked the right questions. So if a salesman knows a car has, for example, been badly damaged and repaired and does not tell the customer, he could later be held liable if the customer subsequently discovered that the car had been damaged and repaired.
