VW Touran - Sale of Goods Act if VW dealer has on bust - jmp466

I bought my Touran New from a dealer who has since gone bust. Can I pursue VW via the small claims court for a manufacturing fault (ESP Tevis Mk60) or am I stuck because I can't go via the suppying dealer? Their good will offer was 20% but the local dealer did assure me in an email that the orginal faulty design had been fixed and the fault would not reappear in the replacement repair kit.

If its still under warranty then any VAG agent can be approached.
