i was recently hit by an oncoming vehicle who was overtaking several parked cars on her side of the road. She was considerably over the centre of the road even though she could have safely moved nearer to the parked vehicles. The single carriageway road is wide enough for 3 average size vehicles to pass safely. She is claiming that I am partly at fault even though I was as close to the curb as I could go without hitting it. Who is at fault?
