make sure you pull the back seat squab up and check the floorpan here, 3 door corsa"s can easily buckle up here as the chassis ends stop by the tank,also look to make sure both rear quarter panels havnt gone out of true.

I expect it could be much more than 700. I was rear-ended in a Mk2 Jetta - damage estimate was at least that, as 700 was the assessed value before the write-off, and that was 11 years ago. Creased the boot floor and knocked the quarter panels out a bit. Boot still shut fine, luckily. Got a cheque and carried on driving it.

That does sound very modest if there is damage to the bodywork of the car. I've been told that my Fabia will cost 500 to fix and that is only for a new rear bumper: the car is otherwise undamaged.

Yes they can, but they wont. No injury, no interest. Plus you cant prove what time the accident took place so the telephone evidence is not valid.

Watch out for the "he reversed into me" defence.

It can be done (i know someone with a company which is a clearing house for these requests), but it's unlikely that they'd be allowed to do for a member of the public and as someone (TVM) said, you need to prove the time of the accident. Who's to say that she didn't start her call after she hit you.

I realise that it's not everyone's choice, but I've found that for the minimum amount of aggro the best way is to put it in the hands of your insurance company and let them sort it. My view is that this is what I pay them to do.

Hand it to one of the specialised claim companies (I used helphire and can recommend them) - your insurance co. probably can't be bothered one way or t'other.
Make sure you get yourself (and any passengers) thoroughly checked medically.
No-one will care that she was on the 'phone at the time.

I would have informed the police of the phone usage and phone number, taken all details, taken photos with the flash disposable camera I carry and recorded the conversation with my disctaophone I carry in my cars. Problem sorted but a damaged car, never to be the same again. Regards Peter

I tried this last year when the the daughter of the folk opposite me reversed off their drive straight into the side of my car.

I thought I'd leave it to my insurance company but they did nothing, I mean nothing. It was me that had to do the calling to her insurance company and the garage. They didnt have a clue what was going on even though I had told them atleast 4 times.
Nothing is on the computer I kept getting told.
(It was like the scene out of Little Britton, 'computer say's no').

When my insurance runs out in June I will never be using a certain insurance company again.

My wife's car was hit by builders truck - wife in correct lane, builder in wrong lane, but in statement to his insurers he says he's in correct lane ,wife in wrong lane. Insurer never checked lane markings and even suggested we accept 50/50 blame.
In the end I had to go to junction,take photos of signs/lane markings etc. then builder said "ah but lane markings changed since accident" so I had to get letter from Highways Agency stating signs etc unchanged since accident date. Eventually we go to small claims court with evidence & win. In 2 years I never got one retured phone call or letter answered by insurer.
It was a well known telephone/internet company - presumably their rates are so cheap because they have no staff to pay !!

If the insurance company, or the third party give you the run around, go for the Small Claims Court route and don't forget to claim for time off work, loss of use of car, every phone call you make, every letter you write etc.

I had to do this a few years back and it was so quick it surprised me. This was after my Ins Co wanted to pay out on my insurance so I would have lost my NCB and got my premium loaded etc.

When I did it the Small Claims Court gave me a booklet that had a template to help you draft the claim.

If you end up in court, then you can ask for disclosure of her phone records. If she refuses to give them, then the judge will draw his/her own conclusions.

However, if she is cute, she will use her husband's/boyfriends/mates phone number. How will you prove that this is not the phone she was using at the time of the accident?

A Judge is highly unlikely to accept the phone records as evidence without some corroborative evidence, such as being arrested and that actual phone seized at the scene.

Maybe in a criminal court (with a criminal burden of proof) but in the small claims court, pretty much anything goes.
