Incorrect details on parking ticket - H.
Does anyone know what the legalities are regarding having the correct details on a ticket? I was issued with a ticket where the vehicle colour was marked as red when the vehicle is actually white. I wrote to my local council and they kindly sent a picture of the vehicle and a note (supposedly) written at the time by the attendant saying that he had noted the colour incorrectly; they consider the ticket is valid. I'm not claiming that I hadn't parked illegally, just that the ticket is void because the details are incorrect. Any ideas?

What was the infringement?

If it was an overstay at a 30 mins max limit or such like, you may be able to challenge the powers of observation that lead to the ticket being issued.

For example, if you have a white Escort, how can you be sure that he did not get confused with another Red one parked there earlier?

If it was just plain parking on double yellows or such like, the fact he had your correct reg no and the ticket was on the car when you arrived back at it, I would suspect that arguing over a technicality such as this will not get you far.

However, I remember when working as a Special Constable, we were told that the pocket book had to be accurate, or the whole book could be help up in court as a lie. For example, if we got a physical description wrong in our pocket books, then where is the credibility in everything else we note down?

Another time I was given a parking ticket in Coventry for failure to pay for a ticket in a car park. It was late at night and the requirement to pay was not well lit.

I contacted the Council and explained that we had spent a reasonable sum of money (been to see a film, had a meal etc) in the City and I was not in the habit of trying to save a few pence on parking. All 4 of us had missed the pay and display meters and signs all shrouded in darkness.

I explained that had the signs etc been obvious I would have only been too happy to pay. Indeed I offered to send them the 30pence for parking etc. They waived the ticket in the interest of good relations, and no, they did not require me to send the 30 pence!

Thanks Hugo - suspect there may be no mileage in this. Offence was simply parking on a double yellow so no question really. But my point was exactly as you say - if you can't trust 'em to get the details right what can you trust?

All a picture will do is prove that they have the details incorrect. A mistake is a mistake, what if they got the reg no wrong? What if they put the ticket on the wrong car? Wrong date etc etc.

PU's opinion would be useful here, but I suspect that you would win if it went to court.

I think that you should be able to get the ticket over turned.

I believe that a ticket should be able to stand up in a court of law and if they filled it out incorectly then I believe that they have no case against you.

Colour does not identify a vehicle.

What does?

The Registration Number.

Now if they have this wrong then you are on a winner. Not so, I would submit on wrong colour alone.

But if you get a ticket for a white Focus with reg PI 51 ING and your\'s is a blue Focus with reg PI 51 ING then how can it be proved that it is not a fake plate?

It has happened to me with a speeding ticket and my only defence (besides me stating I was not on that road at that time - which counts for bügger all - was that the VW Corrado in in the photo was bright red (like Ford red) and although mine is listed as red on the logbook, it is such a dark red that is is usually mistaken for black.
