A BILL TO Make further provision about the retention of vehicle registration marks pending transfer. E IT ENACTED by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:— 1 Retention of registration marks pending transfer (1) For section 26(1) of the Vehicle Excise and Registration Act 1994 (c.22) (retention of registration mark pending transfer) substitute— “(1) The Secretary of State may by regulations provide for— (a) a person in whose name a vehicle is registered under this Act, or (b) if that person so requests, another person, to be granted a right of retention in respect of the registration mark for the time being assigned to the vehicle. (1A) In subsection (1), the reference to a right of retention is to a right, exercisable on a single occasion falling within a period prescribed by regulations made by the Secretary of State, to have the registration mark assigned to some other vehicle which is registered under this Act in the name of— (a) the person to whom the right is granted, or (b) some other person nominated by him in accordance with regulations made by the Secretary of State.” (2) In subsection (2) of that section— (a) in paragraph (a), for “such a right (a “right of retention”)” substitute “a right of retention”; (b) in paragraph (f), for “subsection (1)” substitute “subsection (1A)”. (3) In section 62(1) of that Act (other definitions), in the definition of “right of retention”, for “(2)(a)” substitute “(1A)”. B 5 10 15 20
2 Short title This Act may be cited as the Vehicle Registration Marks Act 2007.
