Should I take legal action against Mercedes-Benz for repeated paintwork issues with my SLK?

About a year ago I emailed you with the dreaded problem of Mercedes-Benz Fire Opel red paintwork blistering. You told me at the time that I lawfully have to give them the chance to put the problem right, which I did. After 10 months of having my SLK resprayed (back to metal) its come back again with a vengeance, only this time big blisters. I've had it taken back to the bodyshop for inspection and they said it's a "paint adhesion problem". I really don't appreciate being treated like a fool (again). I have a car that's only done 17,000 miles cost me £35,000 and is now worthless.

I have been told by Citizens Advice that I need to go back to the original place of purchase. I am now determined that if I need to take legal action I will, despite the cost. First, I am going to wait to see what the paint manufacturer's representative says when he inspects the car after the holiday. I just want to see who accepts blame because I'm not even prepared to accept a respray again knowing there is more of an underlying problem that Mercedes-Benz are keeping quiet about.

I fully understand, but to claim for a significant proportion of the cost of the car this will mean a full County Court action that may not leave much change out of £10,000, and I should further warn you that MB UK is a formidable adversary. You may not be able to claim your legal costs back. So take professional advice about this. There is a problem with some red paints generally. Worldwide production of metallic reds was affected by the Tsunami in Japan and there have been a few other reports of problems with the colour. (I have a metallic red Renault outside, so far, so good.) All that said, I think the dealer will probably bend over backwards to accommodate you, so "be nice" and don't take any legal action unless it becomes a stand-off.
