Is Honda liable for structural damage to my 2010 Civic?

I have 2010 Honda Civic. I took it for its first MoT and the garage asked me to come and look at the car. It would not pass because the spot welds over the strut top had come away, the wheels were out of line and the car could not be driven any more. I was told to take it to Honda as it would be a warranty issue.

I did this and as soon as a mechanic looked at the car he told me that the robot that welded the car wanted sacking. The dealer had it for a fortnight after which he said the damage was my fault as I must have hit a speed bump or pothole, but there is no damage to the wheels or any other part of the car. Even the staff at the Honda dealer were shocked with the decision. They then told me it would cost £2500 to £3000 to repair and to contact my insurance, which I did. My insurer sent a vehicle inspector who said the car could not be claimed on as it was a gradual structural defect and Honda should sort it out. I am now paying an independent vehicle inspector and he also says it is a structural defect and Honda’s fault. Have you ever heard of this before on any Honda and what is your advice?

I've never heard of this before, but the evidence you have given me here points to a manufacturing structural defect and that would make the dealer liable. Time to get heavy. Write a letter to the dealer principal of the dealership that sold you the car and send it by Post Office special delivery so it becomes a matter of record. Tell him you want the car properly repaired at no cost to you and that you want to be supplied with a replacement vehicle for the whole time of the repair. Since this is also retrospective, you want the hire cost of the replacement car for the entire period your car was off the road. You also want all your costs associated with the claim refunded. If he refuses, you will sue using www.moneyclaim.gov.uk and the small claims track of the County Court. But obviously if you have smacked the car through a pothole or over a speed hump and that caused the damage, then you could lose your case.
