Extended Warranty purchased - Mazda were aware of technical issues during original warranty

Hope you can help me with this query, I have a Mazda 3 Sport 2.2 Diesel 2010 Model. The warranty on the vehicle ended in December 2012 but I took out the extended warranty for another year.

The vehicle is now at a Mazda garage having the engine and gearbox taken out as the injector seals have leaked oil and might have caused damage to the engine. At the moment Mazda has not yet said whether they would cover it under the extended warranty, but I have found out that Mazda were aware of the issue since October 2012 issued under their technical bulletins.

Knowing this and that Mazda were aware, what do you think my rights are, knowing this when dealing with Mazda? I am just preparing for a possible showdown on the expense of the job as the diagnostics will cost £1400 and the parts could be up to £4000 - the extended warranty says that is might not cover all parts.

The good news is that the limit on small claims in the county court rose to £10,000 from April 2013, so that is in your favour. I think they will simply fix it under the warranty. If they don't, threaten small claims track action. I hope the car is with the dealer who sold it and the warranty to you. If not, matters could get complicated.
