My 2006 Mercedes-Benz A-Class has a serious rust problem - why won't Mercedes' warranty cover the repair?

I recently purchased a 2006 Mercedes-Benz A170 from a non-Mercedes garage. On washing and waxing my pride and joy I noticed three rust bubbles on the lower part of the front passenger door, so immediately took the car to my local Mercedes body centre for inspection. An inspection was carried out with a report being sent to Mercedes Mobilo Life warranty department. I was then informed by the body centre that the car was rusting from the inside out and would require three doors to be replaced as a result of paint failure and/or sealant failure with the repairs costing £3900. As my car had a full Mercedes service history I expected the corrosion to be covered under the Mobilo Life warranty as it is clearly stated in my handbook "In the unlikely event of part of the bodywork or underbody rusting through from the inside this will be repaired by a Mercedes-Benz service centre free of charge for labour and materials to the exclusion of any further claims".

As the car has not had any repairs to the bodywork or paint I fully expected Mercedes-Benz to honour its statement claim. Unfortunately, this is proving not to be the case. The response I have had from MB is that the warranty only covers rust perforation.

Other readers have taken the matter to the Small Claims Track of the County Court and, depending on the strength of their cases and on the logic of the judge, have either won or lost. As far as I know, Mercedes has never allowed any such case to go further than the Small Claims Track because of the danger of then setting a case precedent and opening the floodgates to thousands of claims. But in UK law the responsibility lies with the supplier who sold you the car, not Mercedes-Benz UK. Take the matter up with him.
