Does the new MoT fail faulty ESPs?

A reader mentioned that a new MoT test came into effect in January. Please tell me that this is not so. My daughter has a Volkswagen Passat that has nothing wrong with it apart from the ESP. We help her out with the financing of her car and the repair bill for this is one bill that we cannot afford.

The extra tests came into effect from 1st January 2012, but failures were made advisories until April. The cheapest fix is £225 cost of removing and replacing the ABS/ESP module. That is by www.sinspeed.co.uk.
