Car repaired by main dealer 18 months ago - and now the same fault has reappeared

During a service in July 2008, the main dealer noticed oil in the expansion tank and the oil cooler had to be replaced and engine flushed (£800 of which I contributed 33%) They did'nt do the job correctly and the car had to be returned one month later for a water leak to be fixed.

At the next service 18 months later, the same problem - oil in the water and they want to charge me £800 for a another new oil cooler etc. Car now 85,000 miles and always main dealer serviced.

My point is aside from if they are correctly diagnosing the problem... is there any way i can use the legal system successfully to recover my costs from the garage if LR or the dealer do not cover the repair?

There has been a problem with this engine in this application.

Doesn't make any sense to me to replace the oil cooler again. If they do this, then they should pay for it on the ground s that they did not instal the first replacement oil cooler properly. If it's something else, then they should never have needed to replace the oil cooler first time round.
