Rejecting a faulty from new Mercedes-Benz M Class

From new, my now 18 months old has a gearbox fault , my Mercedes dealer has had the car several times, the last was for 4 weeks. They have admitted that they still cannot find the problem.

I have told them that I wish to reject the car which they accept but they say that I should contribute towards the replacement due to the age of mine.

My car is immaculate, has done 20,000 miles and cost me £52,000 new.

What are my rights in this matter as I have a meeting with Mercedes Sales Managers on Friday 3 August, but nothing has been agreed yet.

Casde law is the Supreme Court ruling in Clegg v Olle Anders on 2003 (see: www.honestjohn.co.uk/faq/consumer-rights/). But you cannot reasonably expect to have had a life of 18 months and 20,000 miles from a car yet not have to pay for it. Average trade price for a 2011/60 reg ML 350CDI SE with 19k miles is £26,250.
