Unresolved long term problem

My wife has a 2007/57 plate Fiesta owned from new and with full dealer service history. Mileage is only 11600. From new it has "jumped out" of second gear on the overrun - usually using engine braking down hill. Doesn't always do it but getting more frequent - enough to be annoying but now verging on the dangerous. This has been reported to the dealer at every service and every time back comes the response "no fault found" despite telling them exactly how to reproduce the fault. Today booked in for a dealer "health check" I again reported the problem . Again nothing found but this time they offered a test drive and guess what? it jumped out of gear down the hill a 100 yards from the dealers! Mechanics advice "you probably need a new gear box". Dealers response "its too old, out of warranty, not our problem, go away and contact Ford yourself!" They don't deny that the problem was reported to them several times while the car was still under warranty. Do I still have a claim against the dealer and if so how would you advise me to proceed.

Unless it was reported in writing with a letter sent by post office special delivery there is no record of the previous reports of the fault.
