My wife’s keeper

On 20 December 2008, I part-exchanged my wife’s car at a dealership. I sent the V5C section 9 form to DVLA notifying them that I had disposed of it. I received a form from DVLA on 1 April 2009 (continuous registration centre) telling me that I had not licensed my vehicle. I replied on the form supplied explaining that I no longer own the vehicle and that I did notify the DVLA. On 08 April 2009 I received a letter asking for £80 (£40 if I reply before 25 April 09) for late licensing penalty stating that DVLA had not acknowledge my disposal in 4 weeks. I called DVLA at Swansea that evening and tried to advise them I was no longer the owner and they advised to explain this to DVLA (CRC). I sent a letter with copies of the invoice from the dealer, proof of taxation, etc and have now received another letter demanding £80 (£40 if I reply before 7 May 2009) explaining that I have failed to license the vehicle and even though I am no longer the owner because notification has not been received I am still liable. Your advise would be welcome as I am sure I read something similar in the Telegraph a while ago.

Same advice as always and same as in the booklet that accompanies all V5s. If you do not receive an acknowledgement from the DVLA of a change of keepership within 28 days the onus is on you to phone the DVLA on 0870 240 0010 and chase the matter up. This is extremely unfair and onerous because even after doing this repeatedly, readers have still been subjected to punishment. But that's the way the system is now run. Don’t blame the hard working people at the DVLA for the rules they are forced to operate under.
