BMW refused my extended warranty claim

I purchased BMW insured extended warranty last year for my 320d E90. At the end of Jan 2013 my turbo failed and intercoolers needed to be replaced. I have kept up with the servicing requirements and had stamps at the correct dates.

For my last oil service in July 2012 I went to a BMW specialist independent garage (VAT registered and who use BMW approved parts).

I paid the bill of £1417.56 for the intercooler to be replaced, warranty excess and hire car with the understanding that the warranty claim had been successful.

However BMW have called today stating that the warranty claim for the turbo has now been rejected. This is because I stepped out of the BMW dealer network for servicing.

They want to charge me £1564 for the parts replacement of the turbo.

The independent garage was shocked by this!

On reading on the internet I have found that people have been told that it is OK to have servicing carried out by an independent garage as long as they are VAT registered and use approved BMW parts.

Where do I stand on this? I have already paid £43 per month for my warranty which appears to have been useless for 12 months (£516) and the repair for my car including excess which totaled £1417.56.

They want me to pay an additional £1564 which is quite frankly ridiculous and if I had been informed of this would not have gone ahead with repair - timing is terrible in the past 2 weeks I have just bought a house and had a baby.

The EC rule covering a car's original manufacturer warranty and servicing outside the network has nothing to do with an extended warranty contract. You have breached the terms of your warranty contract.
